TERMS

Article 1. Applicability
1.1 On all offers, orders and agreements of Cakes by Bien these general conditions apply.
1.2 Accepting an offer or placing an order implies that you accept the applicability of these conditions.
1.3 Of it in these conditions can only in writing, in which case the other provisions remain in full force.
1.4 All rights and claims, as in these conditions and any further agreements for the benefit of Cakes by Bien are stipulated, are likewise stipulated for by Cakes by Bien enabled intermediaries and other third parties.

Article 2. Offers/agreements
2.1 All offers are without engagement and Cakes by Bien of Cakes by Bien expressly reserves the right to change prices, in particular when that on the basis of (legal) regulations is necessary. See also article 3.6.
2.2 An agreement comes only after acceptance of your order by Cakes by Bien. Cakes by Bien is entitled to refuse orders or certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Cakes by Bien shares this within ten (10) working days after receipt of the order.

Article 3. Prices and payments
3.1 The listed prices for the products and services offered are in Euros, including VAT and excluding shipping and handlings costs, possible taxes or other levies, unless otherwise stated or agreed in writing.
3.2 Payment can be done per pay online with Visa, MasterCard or Visa.

Article 4. Delivery
4.1 Orders placed before 16: 00 ordered and paid for the same day sent.

4.2 Cakes by Bien use of PostNL for sending products.

4.3 Delivery times are determined by PostNL:

·          Netherlands: 1 to 2 days

·          Europe: 3 to 5 days

·          World: 14 days

4.4. If there is something wrong with the content of the package, we ask you to contact Cakes by Bien.

Article 5. Retention Of Title
5.1 The ownership of delivered products shall proceed, if you already have what you owe to any agreement on the basis of Cakes by Bien, has met. The risk in respect of the products already at the moment of the episode on you.

Article 6. Intellectual and industrial property rights

6.1 You should all intellectual and industrial property rights which rest on the products delivered by Cakes by Bien whole and unconditionally respect.
6.2 Cakes by Bien does not warrant that the products delivered to you does not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

Article 7. Complaints and liability

7.1 You have the obligation, when episode to investigate whether the products meet the agreement. If this is not the case, you should Cakes by Bien as soon as possible and in any event within seven (7) working days after the episode, at least after observation was reasonably possible, in writing/email and motivated to knowledge.
7.2 If it is demonstrated that the products do not meet the agreement, the relevant products at Cakes by Bien the choice to return, replaced by new products or refund the invoice value.
7.3 If you have a product for whatever reason do not wish to take off, you have the right as an individual product within seven (7) working days after delivery to return to Cakes by Bien. Returns are only accepted if in this case the packaging of the product is undamaged, which also applies that the cost of return shipments for your account.

Article 8. Return/Exchange
8.1 If an article does not meet your expectations, this article may, if unopened and in it's original packaging, be returned within 30 days. The postage is for your own account and risk. When no new article is desired, the amount will be refunded.

Article 9. Orders/communication
9.1 For misunderstood, mutilations, delays or not properly orders and communications resulting from the use of Internet or any other means of communication in the traffic between you and Cakes by Bien, or between Cakes by Bien and third parties, insofar as pertaining to the relationship between you and Cakes by Bien, Cakes by Bien is not liable, except and only to the extent that case of intent or gross negligence of Cakes by Bien.

Article 10. Force Majeure
10.1 Without prejudice to the other rights to come to her, has Cakes by Bien in case of force majeure the right to, at its option, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by you to inform it thereof in writing this and this without Cakes by Bien that is held to any compensation, except in the circumstances to standards of reasonableness and fairness would be unacceptable.
10.2 Force majeure means any shortcoming which can be attributed to not Cakes by Bien, because they do not is due to its debt and by virtue of the law, legal act or in the generally accepted.

Article 11. Miscellaneous
11.1 If you Cakes by Bien to an address in writing, is entitled to send to that address all Cakes by Bien orders, unless you declare in writing to Cakes by Bien of another address to which your orders are to be sent.
11.2 When by Cakes by Bien during a short or longer period whether or not implied deviations from these conditions are allowed, without prejudice to its right will let that direct and strict compliance with these conditions. You can never assert any right on the grounds that these conditions apply Cakes by Bien smoothly.
11.3 If one or more of the provisions of these terms or any other agreement with Cakes by Bien in fight with any applicable legal regulation, the relevant provision will lapse and it will be replaced by a Cakes by Bien by to establish new comparable provision.
11.4 Cakes by Bien is responsible for the implementation of your order (s) to make use of third parties.

Article 12. Applicable law and competent court
12.1 On all rights, obligations, offers, orders and agreements to which these conditions apply, as well as to those conditions, is exclusively governed by Dutch law.
12.2 All disputes between parties shall be submitted to the competent court in Netherlands.
